Shift is Broken Rule Update

The Shift is Broken rule has been enhanced to now be able to manage rules for individual components (timesheets) within a grouped or broken shift. The updates described below are available from Definitiv version 3.13.

A new drop-down option (see screenshot below) on the right side of the rule allows you to select one of the following options;

  • Pass All Shift Hours - Passes down the grouped shift as one component.

  • Pass Broken Shift Components - Passes down each individual component within the grouped shift.

What this update supports

Now that individual components within a grouped shift can be supported, Access Definitiv is able to accommodate more broken, split or grouped shift conditions.

Below are a couple of examples of what can be supported from the SCHADS Award;

Minimum periods of duty
Clause 10.5: Minimum payments for part-time and casual employees
"Part-time and casual employees will be paid for the following minimum number of hours, at the appropriate rate, for each shift or period of work in a broken shift:
(a) social and community services employees (except when undertaking disability services work)—3 hours;
(b) all other employees—2 hours.
"

Example Award Configuration

Minimum hours scenario
Jane works in the Social & Community division. She works the following times in a broken shift;

Shift Penalties
Clause 25.6: Broken shifts

"(e) An employee must be paid the shift allowances in accordance with clause 29—Shiftwork in relation to work performed on a broken shift, provided that:
(i) The shift allowances are only payable in respect of periods of work in a broken shift that satisfy the definitions of afternoon shift, night shift and public holiday shift (as defined by clause 29.2 and in accordance with clause 25.6(e)(i)).
(ii) The night shift allowance is not payable for work performed on a night shift that commences before 6.00 am.
Example: If an employee performs work on a broken shift from 9.00 am to 11.00am (first period of work) and then from 5.30 pm to 8.30 pm (second period of work), the afternoon shift allowance will be payable on the second period of work only.

Clause 29.2: Definitions
"(a) Afternoon shift means any shift which finishes after 8.00 pm and at or before 12 midnight Monday to Friday."

Example Award Configuration

Jane works the following times in a broken shift on a Tuesday;

Doesn’t meet the definition of an afternoon shift. No penalties are applied for these 4 hours.

6.00pm to 9.00pm

This period of duty finishes after 8.00pm. Afternoon shift penalties apply.

The above are examples of how these clauses could be supported in the award engine. Please note, the configurations shown are based isolated rule clauses, however, they would likely need to be part of a larger award condition.
